If the details in the email confirming your order are not correct, or if you are not satisfied with the details in the email, please contact us at email@example.com.
Where we accept your order, we have a legal duty to supply goods that conform to these Terms and Conditions. After the acceptance of an order, Ampler Bikes is entitled to cancel the order without stating its reasons according to our cancellation policy. In such a case Ampler Bikes is obligated to refund the payment already made by the customer.
Ampler bikes are exclusively sold at our web store and shop. We operate with no third-party resellers. Any third-party retailers selling Ampler Bikes products are strictly unofficial. We accept no liability or responsibility for any third party services or for the content of third party advertisements, including, without limitation, any error, omission or inaccuracy contained in their offers, or for any loss or damage that may arise from such offers.
The customer has the right to cancel their order at any time before the product has been shipped out from Ampler Bikes workshop in Tallinn, Estonia according to our cancellation policy. In such a case Ampler Bikes is obligated to refund the payment already made by the customer during 14 days after the cancellation notice. The customer also has a right to return their order according to section 5 of these Terms and Conditions and our cancellation policy.
3. PRICE AND DELIVERY COSTS
All prices on our website are quoted in EUR.
The net prices of our products include valued added tax (VAT). The cost of a bike already includes shipping costs to the European Union*, Norway and Switzerland.
*This does not include specific outermost regions (OMR) that are part of the EU.
For orders from Norway and Switzerland, VAT will automatically be withheld from the net price. Shipping charges are covered by Ampler Bikes. However, all additional customs duties, your local country-based VAT rate and other similar public taxes are paid by the customer.
Companies within the EU who have a valid VAT ID can place VAT exempt orders. Please add your valid international VAT ID to your order in our online shop.
VAT refunds for orders made in Germany, The Netherlands, Austria, Belgium and Estonia, can be claimed according to the regulations and directions of the local tax authorities as the VAT rate is adjusted and reported in these countries regionally.
The displayed prices are not binding to Ampler Bikes. The displayed prices qualify as a price indication for the customer, not as a confirmed offer. Information displayed on this site relating to prices is subject to change by us without notice. The price displayed on the site at the time of any placed order will be the price applicable to that order.
Occasionally, an error may occur, and goods may be incorrectly priced in which circumstances we will not be obliged to supply the goods at the incorrect price or at all. We will (at our discretion) either cancel your order and refund the price you have paid or use reasonable endeavours to contact you and ask you whether you wish to continue with the order with the correct price. If we are unable to contact you or you do not wish to continue with the order at the correct price, we will cancel your order and refund the money you have paid according to our cancellation policy. However, where the correct price of the goods is less than our stated price, we may, at our discretion, continue with your order and return any amount over the actual order price to you. Ampler Bikes will notify any changes or amendments prior to shipping the product or products.
4. AVAILABILITY AND DELIVERY
Information displayed on this site relating to availability is subject to change by us without notice. We cannot guarantee permanent or continuous availability of all products displayed on this site. All Ampler models are made to order and are hand-assembled. Therefore, delivery of all orders depends on the availability of the relevant Ampler models at the time of the order.
We deliver within the European Union, to Switzerland and Norway only. We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order on this site.
Delivery will be made according to the information on the product pages after your order is accepted. The estimated delivery time is noted on the web site at the time you make your order on this site and confirmed per email. The delivery time is subject to change.
We will use reasonable endeavours to deliver the goods on any specified date we agree, or if no date is specified, within 30 days after the date on which we accept your order. In the case of unforeseen circumstances beyond our reasonable control (for example, adverse weather conditions, unpredictable delays caused by traffic congestion, road works, diversions or mechanical breakdowns, unforeseen production delays, delays caused by third-party suppliers, in each case to the extent beyond our reasonable control) we may not be able to deliver the goods within these timescales and we will not be liable for any delay or failure to deliver the goods if the delay or failure is wholly or partly caused by such circumstances. If a timely delivery does not take place, an alternative delivery date will be provided.
5. RIGHT TO CANCEL AND RETURN
Right to cancel and return
You have the right to cancel the contract until the day the goods will be shipped out from our workshop or warehouse in Estonia. The dispatch of the shipment will be notified via email, together with the tracking number.
To exercise the right to cancel, please inform us of your decision to cancel this contract with a clear statement by using one of the following contact details:
Address: Ampler Bikes, Paldiski mnt. 25, Tallinn 10612, Estonia
If you ordered the bike from our showroom in Berlin, you may cancel the order by visiting the showroom in person.
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired. However, if you decide to send the cancellation notice by regular mail, please let us know also by phone or e-mail as the regular mail may take a number of days to reach us:
Phone number: +372 5560 0088; e-mail: firstname.lastname@example.org
This ensures that we can process the refund in a timely manner.
After taking delivery of the bike, you have the right to return the product for a limited period. The return period will expire 14 days after the day you received the product. The bike needs to be sent back or handed over to us without undue delay, and in any event no later than 14 days from the day on which you notify us of your cancellation of the contract. The deadline is met if you send back the bike before the period of 14 days has expired. The return cost of the bike is covered by Ampler Bikes, on the condition that the return and the delivery means are determined by Ampler Bikes.
You, the customer, are responsible for returning the bike in its original condition. The bike must be safely packed into the original Ampler box, if not agreed otherwise with Ampler Bikes. In case of questions, please contact us for packaging instructions. All the extras and the original components that are part of the delivery, including the charger and original Ampler toolbox, must be returned in their original condition. For a full refund, the bike will be carefully checked and must be in its original condition. In case of dispute, proof such as a photo taken at the time of shipping is required.
We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of incorrect handling of the goods. We will make the reimbursement without undue delay, and not later than – (a) 14 days after the day we receive back from you any goods supplied, or (b) (if earlier) 14 days after the day you provide evidence that you have returned the goods, or (c) if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.
In case you have used a leasing and/or insurance provider through the Ampler website, your leasing and/or insurance contract will terminate together with your cancellation of the purchase contract.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless we have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods or you have supplied evidence of having sent back the goods, whichever is earlier.
You are liable for any diminished value of the goods resulting from handling of the goods other than what is necessary to establish the nature, characteristics and functioning of the goods.
Cancellation by us
We reserve the right to cancel the contract between us without cause. Here are some examples of why it may be necessary for us to cancel the contract: we have insufficient stock to deliver the goods you have ordered; we do not deliver to your area; or one or more of the goods you ordered was listed at an incorrect price.
If we cancel your contract, we will notify you by email and will credit your account with any sum deducted by us from your credit or debit card as soon as possible.
6. TITLE AND RISK
You will become the owner of the goods you have ordered when they have been delivered to you and we have received full payment for the goods. Once goods have been delivered to you or a person nominated by you, they will be held at your own risk and you will be responsible for them.
The bike is manufactured according to EN15194 regulations. The bike has a maximum standard speed of 25 km/h and a 250 W power limitation. You will take the full responsibility for intentionally or unintentionally altering any features or motor settings of the bike, including those that can be changed to increase the maximum speed or power of the bike.
You will be taking the full responsibility for using the bike in accordance with the legal restrictions in your country’s traffic regulations. Road safety and traffic rules differ within the European Union, Norway and Switzerland. Before use, make sure what your country-specific rules are.
Our bike comes fully assembled except for the handlebar and pedals. All the tools needed for assembly are included in the package along with the online link to an assembly manual. The assembly of the handlebar and pedals are your responsibility and they need to be assembled according to the instructions in the provided manual, after the bike is delivered to you.
You are fully responsible for your bike after delivery of the product and take full responsibility for the last phase of assembly as described above. You are responsible for evaluating your abilities to do the last phase of assembly and, if necessary, turning to a professional bike workshop for assistance or requesting assistance from our customer support.
8. WARRANTY AND GUARANTEE
All Ampler bikes have a 2-year limited warranty period, starting from the date of delivery, on all original components (frame, fork, handlebar, power panel), electronics (motor, controller) and battery.
All the bicycle components are guaranteed against manufacturing defects (materials and workmanship). During this time, Ampler Bikes is liable for replacing or repairing the components subject to the warranty. The warranty is valid in EU member countries*, Norway and Switzerland.
*This does not include specific outermost regions (OMR) that are part of the EU.
Delivery damages should be noted and signed on the delivery act in case such damage is visible without removing the package. In case of delivery damages, Ampler Bikes should be informed immediately after the arrival of the package (within one week). Proof of purchase is necessary. Ampler Bikes requires a record of the damages on a photo or a best possible alternative proof.
If any damages occur due to the fault of materials or workmanship during the 2-year guarantee period, Ampler Bikes should be informed immediately. In case damages have occurred, the bike should not be used before repair. Customers are kindly asked for most detailed description possible about the issue and photo and/or video materials if possible. Ampler Bikes is your contact for all defects and will handle the processing of the damages.
The repair or the replacement of a defective bike is handled by Ampler Bikes, by either covering the repair costs incurred using a professional bicycle workshop of the customer’s choice or by transporting the bike to Ampler Bikes’ workshop in Tallinn or Berlin at our cost. We will instruct you regarding the repairs procedure after we have received your notification of a defect. The defective component will be replaced with another original component or with another equivalent component.
Please note that Ampler may refuse covering the repair costs in case you have repaired the bike without a prior notification and authorization. This is because not all workshops have the necessary tools and parts for a correct repair. Moreover, non-authorized repairs hinder our ability to review the defect and decide whether it falls under the warranty.
Warranty does not cover follow-up maintenance or later integration of extras. Warranty does not apply in cases of modifications, improper assembly or incorrect maintenance. Where the claim is deemed not to be warrantable, we will look to offer a reduced cost replacement.
Please note also that the above describes the sole remedies in case of a defect under this warranty. Specifically, no cash refunds are offered in case of defects under this warranty.
The battery is considered defective if, within the 2-year period, the remaining capacity of the battery becomes less than 70% of the original capacity. The capacity will be tested by a battery capacity analyser at Ampler service points.
Wear and tear
With your purchase, you acknowledge that each bicycle is subject to wear and tear in normal use. The warranty will be declined in case of normal wear, tear, neglect, abuse, misuse or crash damages.
The Ampler bike comes with certain wear and tear parts, which are carefully selected from other manufacturers and which do not fall under the Ampler warranty in case of normal wear and tear:
COMPONENT – PRODUCT WEAR NOT COVERED BY WARRANTY
- Grips and bar tape – Compression, abrasion and contamination
- Tires – Tread, sidewall, or bead wear
- Pedals – Mechanical wear due to engagement and disengagement, worn out bearings
- Saddle – Abrasion and wear from falls and general use, and contamination from water and dirt
- Chainrings and chain – Mechanical wear between chain and chainrings
- Brake pads – Abrasion between brake pad and braking surface
- Bottom bracket – Wear of bottom bracket bearings
- Headset – Wear of head bearings
- Rims – Excessive impact on uneven roads
- Hubs – Worn out bearings and rotating parts (i.e. freehub body)
- Belt and belt rings – Mechanical wear between belt and sprockets
- Mechanical wear – Includes colour coating
These components are subject to inevitably normal wear and tear. As these parts sooner or later reach the end of their service life, the normal level of wear is dependent on time, the care taken and maintenance used by you and subject to their exposure to rain and water, dirt and mud, sand and dust. Read further about how to take care and maintain your bike in the Ampler Bikes service manual.
Please note that the above parts are subject to the Ampler warranty in case their service life on your bikes is shorter than is deemed normal by the manufacturer of the respective part.
Failure to service, neglect and crash damages
The Ampler guarantee does not apply to damages caused by crashes or by your failure to follow the Ampler Bikes service manual. The guarantee may be declined also in case the damages were caused by using the bike after any damages had occurred.
Replacement or repair
You have a right to demand replacement of the bike only in case defects of the bike are such which, taking into account the nature of the defects, the cost of replacement and the cost of repair, justify replacement of the bike instead of repair.
Your Ampler warranty only applies for two years, starting from the date of delivery. Warranty requests submitted after expiry of the warranty term will be denied.
In case the warranty request is submitted more than two years from the date of delivery, you must be able to prove that the damages occurred before expiry of the warranty period. Please note that if any damages occur due to the fault of materials or workmanship during the guarantee period, Ampler Bikes should be informed immediately. In case damages have occurred, the bike should not be used before repair.
In the case of a warranty, you must immediately inform us by emailing us at email@example.com (Ampler Bikes, Paldiski mnt. 25, Tallinn 10612, Estonia, phone number: + 372 55 6000 88).
To the extent not prohibited by law, we accept no liability for any:
- loss which is not foreseeable (loss is foreseeable if it was a reasonable consequence of our breach or if it was contemplated by you and us at the time you and we entered into our contract);
- loss which arises when we are not at fault or in breach of these Terms and Conditions; and
- business loss (which includes loss of profits, loss of business, contracts, goodwill, business opportunity and other similar losses, as well as business interruption).
Nothing in these terms will affect any liability we may have: (a) for fraudulent misrepresentation; (b) for death or personal injury arising from our negligence: (c) for breach of any condition as to title or quiet enjoyment of or in relation to any goods supplied by us; (d) in relation to any other liability, including any liabilities under sale of goods or supply of services legislation, that may not by applicable law be excluded or limited.
10. EVENTS BEYOND OUR CONTROL
We will have no liability to you for any delay in delivering the goods you have ordered, if the delays caused by any event or circumstance beyond our reasonable control (including, without limitation, accidents, extreme weather conditions, fire, explosion, flood, storm, earthquake, natural disaster, failure of telecommunications networks, inability to use transport networks, acts of God, terrorist attack, war, civil commotion, riots, strikes, lockouts and other industrial disputes, acts or restraints of Government, and imposition of restrictions on imports or exports).
11. PROTECTED RIGHTS
You shall not reverse engineer or disassemble the bike or otherwise attempt to derive the trade secrets or the technical specifications of the components contained therein. Any such attempt immediately voids the warranty and your right to return the bike.
Furthermore, you are liable for any damage caused to Ampler by such reverse engineering, disassembly or the use of information so received. You agree hereby that in case of violating this section of the Terms and Conditions, you are obligated at the request of Ampler to prove that you have not used any information for any purpose (including business, research and development or any other purpose).
You further agree that in case you have used such information for business purposes, Ampler is entitled to receive as reimbursement all income that you have garnered by the use of the information.
If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable, the validity, legality or enforceability of any other part of these Terms and Conditions and the remainder of the provision in question will not be affected.
No person other than you and us shall have any rights to enforce our contract.
If we fail to insist that you perform any of your obligations under our contract, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
You may not assign or transfer your rights or obligations under our contract, unless we agree in writing. We may update, vary and amend these Terms and Conditions from time to time without prior notice. Each time you order or otherwise purchase any goods from us, the Terms and Conditions in force at that time will apply (as set out on this site). Please check this site to ensure that you understand which Terms and Conditions apply.
13. LAW AND JURISDICTION
Our contract, including these terms and conditions, shall be governed by the laws of Estonia and will be subject to the jurisdiction of the courts of Tallinn, Estonia.
